Will My Boss Know If I Go to Rehab?

No. In almost every case, your boss will not know you went to rehab.

Here is why.

Your Privacy Is Protected by Federal Law

Whether you are in Clarksville, Nashville, Dickson County, or anywhere else in Tennessee, your medical information is protected under a federal law called HIPAA. In plain English that means no treatment facility can share anything about you with your employer, your coworkers, or anyone else without your written permission. Your decision to get help is yours. Nobody can disclose it without your consent.

Your Job Is Protected Too

This is the part that surprises most people. A federal law called FMLA, the Family and Medical Leave Act, may protect your job while you are in treatment. You can take up to 12 weeks of job-protected leave without telling your boss you are going to rehab. You simply tell HR you are taking medical leave. The details stay between you and your doctor.

To qualify you generally need to have worked for your employer for at least 12 months and work for a company with 50 or more employees. If you are not sure whether that applies to you, call us before you make any decisions and we will help you figure it out.

Will Rehab Show Up on a Background Check?

No. Going to rehab does not appear on a standard background check. Your treatment history is protected medical information and will not affect future employment.

Your EAP Is Free and Completely Confidential

If your employer offers an Employee Assistance Program, an EAP, it is worth using. Your EAP counselor cannot report anything back to your employer. It is a free, confidential benefit that exists specifically for situations like this one and most people in Tennessee never take advantage of it.

What If I Have a Safety-Sensitive Job?

If you work in healthcare, transportation, or another field with specific federal regulations around substance use, the rules are a little different. Call us first and we will talk through your specific situation privately before you make any decisions.
